Can individuals sell wine to retailers in NY?

I tried “the google” with little success, thought someone here would know. Can I, as a resident of NY, sell wine to a licensed wine retailer in NY, legally?

Do you mean wine you yourself make, like in your bathtub or garage, for instance? You may have to sell through a wholesaler first, although to be honest, I don’t really know. Sorry.

Yes. It is legal to sell your wine to a licensed retailer in NYS.

…but I believe it is illegal to do it on consignment, although it happens all the time.

In NYS you can never sell your wines without a license to sell … Bottom line… Taxes need to be collected and no way this state will ever let you do business without paying tax … It 100% it’s 100% illegal to sell alc in NYS W/O a license…

You can bring wine backs to exchange… A loop hole … You can’t ever sell wine in NYS without a license… End of story …no matter how many years you have been doing it… It against the law…

N.Y. ABC LAW § 99-g(1)(a) states:

“Any nonlicensed person legally owning wine and/or liquor is authorized to sell that wine and/or liquor to a licensed person or through a licensed person to an individual or group of individuals by any lawful method of sale or by means of an auction by a licensed person conducted pursuant to this section. The licensee involved in such sale shall ensure that each bottle of wine and/or liquor sold from a private collection has a permanently affixed label stating that the wine and/or liquor were acquired from a private collection.”

I might add same class they told me farm winery can’t sell wholesale…that was wrong too …

It sucked … So many rules that were told to us that were just wrong … Must sell via a distributor … They said its the law… Not true…

The above example … This was gone over too, maybe I. Relation to farm winery laws… ??? … Who knows with them …

Told we had to give a bag out … Not true if farm winery …

Told could not sell beer … Again not true we can by the glass too…

Told us can’t open before 12 Sunday … Again not true … 9 to 9 is permitted…


So many laws so many wrong answers … To be fair the class was over 12 years ago … Hopefully the teacher knows the law by now…

This must have changed a while ago. Definitely hasn’t been the law for at least five years.


Chambers Street regularly sells bottles from cellars they’ve purchased, so I would imagine that you can sell your wine to a retailer. Their bottles have those little labels on the back.

Can wine shops sell corkscrews and glasses now? That was once verboten too…

Each was a law that was applicable to stores not farm winery operations … We called and consulted with the NYC sla to rectify all issues that pertained to operations that were not clear… That said when head council gives you bad info errors and omissions come in they are human too…

Thanks. Seems a way to get around the consignment issue would be to store some wine at a wine store, and only sell the wine to the store after they make a sale to another consumer? Semantics I know…
