As someone who worked in distribution for almost 10 years and ordered a number of containers of wine I understand the frustration. But, it’s $2.50/case extra, or .20 per bottle…if you’re average case cost is $250, this is just a drop in the bucket. Get your wine delivered, suck it up, and look for a better shipper next time.
They have some of the best prices on wine also in the country so they get deals through FedEx or UPS for shipping. When you do volume like they do they are not paying prices the average person would be paying to ship a box of same weight/dimensions.
Its mob rule… it has been as long as I am alive., trucks , docks, boats, … I’m not going to bother going into stories that are so absurd you would not believe me…
That is bad man, how do you survive with that? My heart goes out to you
It would be very interesting to see whatever it was you had in writing, William. Was there fine print, for instance, that said the price would be fixed more exactly at the time of shipment? There are a lot of lawyers here who could parce the language and tell you if you have a good legal position.
It’s very hard to know if we should share your outrage when we don’t know any details.
Don’t take money from shops or do endorsements. I make all of money in wine from my clients whether it is a corporate event or helping clients stock their cellars that way I represent the client only. I will take free samples though and write up wine reviews but don’t guarantee good press.
Which, if William is dealing with some kind of middleman who simply passes through the shipping line’s charges, wouldn’t necessarily be odd. But William hasn’t given us much information to go on.
we have 6 other shipments in various stages - with the same shipper - Gori, so I think I’ll wait…
we got delayed and stopped importing during the 25% Trump tariff.
The Dom. Arnoux & Y.P.C.M - those we can pass on any addt’l cost,
but the bulk of the wines & Champagne, its an issue…
But that doesn’t answer the question of what Gori put in writing – what sort of agreement you had with them.
I see they are a freight forwarder. It wouldn’t surprise me if their standard contract allows them to pass on additional charges they incur from shipping companies. Is something like that in the fine print, perhaps?
Thanks for your interest in getting to the bottom of the matter - John Morris,
however, this is not the forum I would begin to delve into these details.
Has nothing to do with Berserker - just this is a public forum -
and my issues are not to be discussed in public like that
Thank you though
Very odd, William. You actually made this a public board issue, and you have a Harvard educated lawyer willing to give you insight.
Now of you want my lower-end, country lawyer insight:
I’m guessing the quote or agreement had very detailed force majeure language. And most force majeure clauses these days are not limited to so-called “acts of God.” Many define force majeure to include any circumstance which is outside of the control of the contracting party. In fact, more modern, post-Covid clauses, explicitly reference supply chain delivery issues, delays and simple material cost escalations, which include fuel.
Maybe, people have given opinions about the situation, which the op complained about because people don’t have access to the contract that he didn’t bother to post. It’s the Berserker enough for a Friday night?
