John Fox (PC) Update

Got an e-mail this morning from USDOJ informing me that Fox's release date has been changed to February 22, 2021 and that he is not eligible for parole. Not sure if the new date is earlier or later then previous release date.
I want to be known by my indulgences.

JF should receive 6 months of home detention (or possibly a half way house) as a last component of his sentence, which is in place of time he normally would have had to serve; and then there are other good time reductions of his sentence. The relatively recent federal First Step Act requires 6 months of home detention for many people, and JF looks like to be an eligible candidate. When he gets out he will have have supervised release, which is essentially probation.

I have said this before the whole debacle to some local wine geeks. The prices are great but concerned about the wait time. The only wines I ever bought from them were in stock.

Slight thread drift - I thought there was word that there would be some checks coming from the bankruptcy to those that lost money. Was I mistaken or?

The bankruptcy isn't wrapped up, yet, although it looks like it's getting close. Any checks would come after then know how much money has been collected and how much is left after paying off the entities involved collecting the money and the creditors farther up in the line.

I also received the update. I think he's being released a little sooner, probably for reasons Christopher mentioned earlier.

I imagine the civil suits are still live, as well as any restitution required by the court.

He agreed to repay at least $45M as part of his sentencing deal. Personally, I think modest checks from the bankruptcy trustee are more likely.

The attorneys the Trustee hired are keeping 40% of what they collect, I forget (MY memory is blinded with hate and anger) how much if any the court appointed Trustee is keeping, the state Attny who made the sentencing recommendations I always assumed after reading his recommendation that he had fallen in love with Mr. Fox and probably cannot wait till he is free - and I wish to fark with the man to the full extent of the law and nature. I have to ask my attny just what are my limits.

I cannot imagine their will be money to divide to be given to those who helped pay for his life style.

It's too easy to complain about the lawyers, but it's inevitable in cases like this that the professional fees eat up an unfortunate portion of the assets.

This is the worst kind of bankruptcy: very few assets relative to the liabilities; terrible business records; a huge number of customer-claimants, with different circumstances; and what amounted legally to preference payments (customers who were made whole when the business was insolvent).

But what was the alternative? A mud-wrestling match among the customers, mortgage holders and banks? Someone had to go in, figure out what happened, figure out an equitable plan to present to the court, and fend off the claimants who thought they were given short shrift.

+1 it is the criminal action in the first place who is responsible. Like arguing about a toxic waste spill and then complaining about the cost of the cleanup crew to haul away the mess..
