K&L wines (California) - to cease shipment to New York

As of yesterday, K&L wines cannot ship wines to New York.

According to their website.

We can NOT ship to the following states:

If you are ordering alcoholic beverages to be shipped to one of the following states...
AR, CT, DE, FL, GA, IA, IL, IN, KS, KY, LA, MA, MD, ME, MI, MN, MS, MT, NC, NJ, NY, OH, OK, PA, RI, SC, SD, TN, TX, UT, VA, VT, WA, WV
...we won't be able to accept your order over the Internet. Please call (800) 247-5987 for more information.

Interesting that they cannot take the order 'over the internet' but instead ask you to call. Does that mean they can take it if you call?

If they use a 3rd party shipper that can ship to the state they can't ship to. Over the phone they present that option. Of course that increase cost.

This is news to me here in WA. I received a shipment from them last month and just mailed a shipment to them for auction. I wonder if they are just putting the responsibility on the client and shipping anyway?

I have about 15 cases on pre-arrival so we will see.

Wow, that's 34 states they can't ship to. It's getting crazy. Hate to get political, but it should make you think twice about all the other corruption that is going on in your government.

Confused...what is the difference between UPS no longer picking up wines to those states they won't ship to and Fed Ex only picking up packages for states they can ship to? Isn't that the same thing? Each will only ship wines to the states they can ship to and will no longer ship wines to the states they cannot ship to. Unless I am missing something.

Call me confused too. I was told that UPS is not picking up packages at all from them, whereas FedEx still is. I'm only going by what I was told.

Called K&L and was told that UPS not picking up any wines for shipment anywhere at this time, and as of now Fed Ex is still picking up shipments (and it did not sound as if there were any new restrictions as to state than before) but that "that could change at any time". They sounded as in the dark as I am.

It is unfortunate as I enjoyed doing business with them over the years, but they are no longer permitted to ship alcohol to New York. They issued me a refund for an order I placed last week.

This shipping change will most likely reduce the number of bidders for their auctions, reducing prices realized when selling as a result. Good for auction buyers who live in one of the authorized ship to states. Bad for sellers though.

Just called K&L wines. Was told that as of three days ago, UPS stopped shipping alcohol to all states--even states where it is permitted, such as Oregon. That also includes in-state shipping too. Fed-ex, however, is still shipping wine.

There seems to be a few different explanations being offered. KL told me that this is because of New York State targeting the type of retail license that KL holds, and NYS not permitting shipments any longer. I received multiple cases from Benchmark and Envoyer in CA to me in NY just this week. Is NYS targeting only KL's license?

I can't understand how there was no warning or notice. Did this just happen overnight? NY clients are now scrambling to get their wine.

Wasn't there a US Supreme Court case a few years ago that was supposed to end these state-to-state shipping impediments?

I really am confused and frustrated about all of this.

I don't buy wines from local retail shops any longer, but it appears that I may be facing a denial of access to my favorite wineries' products if this scenario is the beginning of a larger trend.

I hope that I am wrong.

This seems like a steady process of elimination, until wholesalers run the entire industry, squeezing winemakers, retailers, and consumers. Like the tail wagging the dog.

Ironically, the most likely outcome is that it will accelerate the inevitable Supreme Court case for retail that parallels the Granholm case for wineries. With the hopeful (though certainly not guaranteed, given the [expletives deleted] tendencies of the SC) outcome that out of state retail shipping will become lawful in any state that allows in state retail shipping.

I know a common sense answer that bolsters the US tax coffers would be out of the question but:

Shipping to be open to all states. 2% tax paid to IRS on every item shipped. That levels the playing field IF the individual states aren't adding their own little taxes on specific items, shooting their own retailers in the foot. Amazon would be helping reduce the national debt. I would stop selling cigars because everybody could buy them online and pay a 2% tax, rather than buy from me with a 22.8 % tax now and possibly an additional 145% tax if Prop 56 passes.

Yes, great store--stopped shipping to IN affordably a while back. With BP, hope this does not augur a trend.

Wineries with the proper permit can ship to MD. It is against current law in MD for retailers such as K&L to ship here.

Retailers do not have the same protection in the law as wineries. The Granholm Supreme Court case made it legal for wineries to ship to any state that allows its own in-state wineries to ship (I assume every state, but not positive). That case (sadly, and inexplicably) did not extend to retailers, so they are subject to the whims (and legal bribery) of each state's alcohol control system. I know that MD retailers cannot ship to California (there are wines in MD I've been interested in), so I assume the reverse is true, no surprise. It's not a matter of licensing, it's that they are completely prohibited.

I know that MD retailers cannot ship to California (there are wines in MD I've been interested in), so I assume the reverse is true, no surprise. It's not a matter of licensing, it's that they are completely prohibited.
California wineries can and do ship to MD.

K&L has not shipped to MD since I started buying wine so I do not buy from them. Vineyards can ship to MD, which means I solely buy from them.

According to shipcompliant.com, there are only 14 states where retailers (not talking about wineries) can ship their wines to, and each have certain requirements regarding permits, volume limits, etc. I also saw somewhere that my state of WA only allows intra-state shipping from retailers to consumers, and it is certainly not one of those 14 states listed...despite the fact that most retailers across the country have been shipping to WA as long as I have been collecting wine. So...I assume that they have just ignored the restrictions. Now whether the UPS issue with K&L is due to them not wanting to ship "illegally" (though why would they not pick up shipments from K&L to "legal" states?), or whether they want to get out of the wine shipment business (perishable goods and maybe they have had too many claims regarding damage?), I don't know. Have consumers been getting emails from any other internet retailers other than BP wine mentioned above?

Yes, that was my point. They can, but retailers don't have the same protection from states prohibiting them.

Not good; I've got a few orders from California retailers up for shipping this season and my preferred ground shipper is UPS because FedEx Ground/Home delivery in my area has been very unreliable and their only pickup location is an hour away.

Why is this freaking issue getting worse, not better?

According to K&L, UPS has gotten out of the wine shipping business. Period. At least from retailers. They didn't say whether UPS's decision applied to wineries.

Why is K&L the only one that has said this? We shall see if all my shipments into CA next week will be via Fedex or not.

I expect that K&L received the same cease and desist letter from FedEx that I received late last week. It begins by reciting how under my agreement with FedEx I agreed to comply with all alcohol shipping laws. It then states that since January 2013 I have made one or more shipments to New York, and demands that I either provide proof that I am licensed to make such shipments or cease and desist. No more shipments to New York for me, either. Sadly, quite soon, it may be California only.

I expect that this was precipitated by a stern letter to FedEx from New York authorities.
