In general agree with Cellar-raiders, but have found him just a little spotty about provenance and conditions. Did you pay with credit card? If so, that might enable a charge-back refund, especially if you have kept all documentation and can forward to your credit card company.

In my kitchen, all perishable food is either cooking, refrigerated, frozen, or being eaten. Sitting on the counter means food contamination or spoilage risk.
(What happens at the shop is another matter.)
