Ok, but as every state is different, I’m not certain this applies across the board. We only sell wine & liquor, folks can’t drink in the store. I don’t think music is a problem in NY.

CA stores can have on-premise service as well, in those cases I can see how BMI could get you.

This has nothing to do with the state. This is a music licensing issue.

You must get a BMI license to rebroadcast music in your store if you meet the following criteria:

"Public performances of radio and TV are specifically addressed in Title 17, Section 110(5) of the U.S. copyright law which states that any establishment, other than a food service or drinking establishment, that is 2000 square feet or larger must secure public performance rights for TVs or radios if the following conditions apply:

For TV, if the establishment is using:

• more than four TVs;
• more than one TV in any one room; or
• if any of the TVs used have a diagonal screen size greater than 55 inches.

For radio, if the establishment is using:

• more than six loudspeakers; or
• more than four loudspeakers in any one room."

OK, so my store is 250 sqft, and my stereo only has 2 speakers.

Good to know, though, as I will pass along this info the folks I know who have stores that fit the criteria.
